TERMS AND CONDITIONS FOR PURCHASE OF PHYSICAL PRODUCTS ON THE COMEDYSHOP.IE WEBSITE
Peer Pressure Productions Ltd (hereafter referred to as “the Owner”) reserves the right to change these terms from time to time. By continuing to use this site after changes are posted you agree to be legally bound by those terms as updated and/or amended.
Returns & Exchanges
All items can be returned with 30 days from shipment date. The packaging of the returned item must be unopened and not damaged in any way. You will be responsible for shipping costs to return the goods to us.
Option 1 - Registered Post By choosing this option you agree to use An Post registered post service to ship your order. This is a trackable service and a 1-2 day delivery is expected (from the day your order is shipped from our warehouse). In the event that your order cannot be delivered an 'attempt of delivery' slip will be left by your postman advising same and your package will be returned to your local sorting office where it will be held for collection for 1 week. If it is not called for and collected by the intended recipient within that timeframe it will be returned to sender and the customer will be contacted. If you understand and accept these terms please choose this option.
Option 2 - Standard Post By choosing this option you agree for Comedyshop.ie to use An Post standard post service to ship your order. This is NOT a trackable delivery service and subject to the terms & conditions of the carrier. Delivery can be subject to delays at busy times of the year. In the event of non-arrival of an order sent by standard post delivery we must wait a minimum of 21 working days before we can investigate. This option is not recommended if you require your order by a certain date. This option is not recommended if you will not be present to accept delivery. This option is not recommended if your items are bulky and will not fit through a standard letterbox. If you understand and accept these terms please choose this option.
Lawful Use
You may not broadcast, copy, download, frame, reproduce, republish, post, transmit or otherwise use Comedyshop.ie content appearing on the Comedyshop.ie site in any way except for your own personal, non-commercial use. Any other use of such content requires the prior written permission of the Owner.
You agree to use Comedyshop.ie only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit the use or enjoyment of this site by any third party. Prohibited behaviour includes but is not limited to defamation, harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or anything which may affect the operability or security of Comedyshop.ie
Disclaimers/Limitation of Liability
Comedyshop.ie content is provided “AS IS” and on an “AS AVAILABLE” basis without any representations or any kind of warranty whether express, implied or statutory of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
The Owner will not be liable for any damages, including indirect or consequential damages, or any damages arising from use or loss of use, interruption of business, loss of data or profits, whether in contract, negligence or other tortuous action, arising from or in connection with the use of Comedyshop.ie
The Owner does not warrant that functions contained in Comedyshop.ie will be uninterrupted or error free, that defects will be corrected, or that Comedyshop.ie or the server that makes it available are free of viruses or bugs.
Orders
All orders for Goods shall be deemed to be on offer by the Buyer to purchase Goods subject to these conditions.
All Goods are offered and sold subject to sufficient stock being available and to the price being confirmed by us.
Cancellation of orders
We may cancel all or part of any order for Goods at any time before the Goods are delivered by giving written notice to the Buyer. On giving such notice we shall within seven days repay to the Buyer any sums paid in respect of a cancelled order. We shall not be liable for any loss or damage arising from such cancellation.
The Buyer may not cancel or vary any order without written consent from the Owner upon terms that shall indemnify us against all losses including loss of profits, costs, damages, charges and expenses incurred by the Buyer.
Price & Payment
We reserve the right at all times to revise the price of the Goods due to factors beyond our control including, but not limited to foreign exchange fluctuations, alteration of duties, increase in cost of production or transport.
Any price quoted by us at the time a Buyer makes an order for Goods shall be an estimate only and the actual price to be paid by the Buyer for the Goods shall be as set out on the invoice including VAT at the rate in force on the date of the invoice.
Payment of the invoice is due on the date indicated on the invoice. If no date is indicated, the invoice shall be due for payment within 30 days of the date of the invoice.
If the Buyer fails to make payment in full on the due invoice date, we shall be entitled to: -
- Charge interest on overdue invoices that shall accrue from the date of invoice from day to day until the date of payment at a rate per annum of 5% above the NIB base rate from time to time in force.
- Cancel or suspend any further deliveries or collections of Goods.
- Appropriate any payment made by the Buyer to such of the Goods, or Goods supplied by us under any other contract with the Buyer as we may see fit.
Any claim against us by the Buyer in respect of Goods shall not entitle the Buyer to withhold payment for any part of any Goods ordered by the Buyer from us, nor shall the Buyer be entitled to set off any such claim against any claim by us for the price of any Goods.
The method of payment shall be as specified on the invoice and all payments will be in Euros.
New accounts may be subject to two trade references and a banker's reference and until such time as satisfactory references have been received by us, no Goods shall be delivered without receipt of payment in full.
Delivery
All delivery dates are estimates and we shall not be liable for any loss or damage whatever due to our failure to deliver the Goods, or any part of them, promptly or at all.
Notwithstanding that we may have delayed or failed to deliver the Goods, or any part of them, promptly, the Buyer shall be bound to accept delivery and to pay for the Goods received in full, provided that the delivery is made within thirty days of the order being placed.
Delivery of the Goods shall be made to the Buyers address on or about the delivery date. The Buyer shall make all necessary arrangements to take delivery of the Goods whenever they are tendered for delivery. We shall not store any Goods on behalf of the Buyer after such date. If we do, we may charge the Buyer a reasonable fee for storage.
We may deliver Goods ordered by the Buyer in separate installments. Each separate installment shall be invoiced and paid for in accordance with the terms and conditions.
Acceptance of goods
The buyer shall be deemed to have accepted the Goods three days after delivery to the Buyer and the provisions of the Sale of Goods and Supply of Services Act 1980 in relation to acceptance are hereby excluded.
After acceptance the Buyer shall not be entitled to reject Goods, which are not in accordance with the contract.
No Goods delivered to the Buyer which are in accordance with the contract will be accepted for return without the prior or written approval of the Owner on such terms as we may determine at our absolute discretion.
Risk and title of goods
The Goods shall be at the Buyers risk as from delivery.
In spite of delivery having been made, title to the Goods shall not pass from us until:
- the Buyer shall have paid the price in full plus VAT in full; and
- no other sums whatsoever shall be due to us from the Buyer
Until property in the Goods passes to the Buyer in accordance with the conditions herein the Buyer shall hold the goods as our bailee. The Buyer shall store the Goods (at no cost to us) separately from all other goods in its possession and marked in such a way that they are clearly identified as our property.
We shall be entitled to recover the price (plus VAT) notwithstanding that property in the Goods has not passed from us.
Until such time as property in the Goods passes from us the Buyer shall upon request deliver up such Goods as the Buyer may have in its possession. If the Buyer fails to do so we may enter upon any premises owned occupied or controlled by the Buyer where the Goods are situated and repossess the Goods.
The Buyer shall not pledge or in any way charge by way of security for any indebtedness any of the Goods, which are our property. Without prejudice to our other rights if the Buyer does so all sums whatever owing from the Buyer to us shall forthwith become due and payable.
The Buyer shall insure and keep insured the Goods to the full price against all risks until the date the property in the Goods passes from us. Without prejudice to our other rights if the Buyer does so all sums whatever owing from the Buyer to us shall forthwith become due and payable.
Until such time as title in the Goods has passed to the Buyer any money received by the Buyer as a result of any insurance claim of whatever nature with regard to the Goods shall be held on trust for us as if it had been a payment received from a third party in accordance with the conditions above and shall upon receipt thereof by the Buyer be immediately remitted to us.
Force Majeure
We shall have no liability whatsoever under, or in any way related to the sale and purchase of the Goods or otherwise for any failure to fulfill any obligation hereunder if and to the extent that such fulfillment is prevented by circumstances beyond our reasonable control.
Intellectual Property and Signage
No right or license is granted under these terms and conditions to the Buyer under any patent, trademark, copyright, registered design or other intellectual property right except the right to use or resell the Goods.
Any Goods sold in retail packaging may be resold by the Buyer only in the packaging supplied by us and in no case may any trade mark other than those supplied by us be marked on or applied in relation to the Goods.
The Buyer undertakes to offer the Goods for sale only through his established high class good quality retail outlets to individual consumers and agrees that breach of this Condition shall be a repudiation by him of these Conditions. The Buyer undertakes to cease supply of the Goods to third parties as soon as it becomes aware that such third party is not acting as an individual consumer.
Third Party Sites/Links
The Owner is not responsible for the availability or content of any third party websites or material accessed through the Comedyshop.ie site. The Owner does not exercise any control or supervision of these linked sites.
Comedyshop.ie does not endorse, and shall not be held responsible for, any content, advertising, products, services or other information on or available from third party sites. Third party sites linked through Comedyshop.ie are not covered by these terms and conditions.
Minimum Technical Requirements
By subscribing to this website you acknowledge that there are minimum technical requirements in order to avail of the site service. These include, but are not limited to, having Internet Explorer version 6 or equivalent and Macromedia Flash version 8 or better installed on your computer. The site is best viewed with DSL 128k/256k. The Owner will do everything in its power to help members resolve any viewing difficulties but the ultimate responsibility for ensuring adequate facilities to view the site rests with each member. General
If any provisions of these terms and conditions are found to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms area intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect.
Login details are intended solely for the use of each individual subscriber and may not be passed on to any third parties. The Owner reserves the right to suspend or cancel any membership where there is reasonable evidence of abuse.
If for any reason Comedyshop.ie is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Owner which corrupt or affect the administration, security or integrity of Comedyshop.ie the Owner reserves the right at it’s discretion, to cancel, terminate, modify or suspend the website.
The personal data provided by any site member in connection with membership of this site will be held and processed by the Owner in accordance with current data protection legislation and Comedyshop.ie Privacy Statement (which is available to view [here])
Law and Jurisdiction
All contracts made under these Conditions shall be governed by the law of The Republic Of Ireland.
All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the Courts of The Republic Of Ireland.

1. Who we are Comedyshop.ie is owned and operated by Peer Pressure Productions Ltd, 108 Upper Leeson St, Dublin 4, Ireland (“Peer Pressure”). Company registration number: 375723. The Carlsberg Cat Laughs Comedy Festival (“Festival”) is a third party event organiser and entertainment provider.
Other third party providers will be engaged for the travel, accommodation and meal elements of each package.
2. Booking You can book a package in either of two ways: • On this website, www.comedyshop.ie • Over the phone, 01 6375006
In order to make a booking you must first accept our Terms and Conditions. This step is included in the registration process on Comedyshop.ie which must be completed as part of purchasing your first order with us. If you are already a member of Comedyshop.ie it is your responsibility to keep familiar with changes to our Terms and Conditions and ensure you are happy with them before proceeding with any transaction on this site.
If you are booking over the phone we will fax or email you a copy of these Terms and Conditions and you must acknowledge receipt and acceptance of same by either return fax or email.
3. Confirmation Our contract with you takes effect when we have processed your booking request and set aside the chosen package(s). We will send you a final invoice and confirmation of your booking which shows the details of the package(s) and the total price payable. This should be checked very carefully to ensure that all details are correct. You must inform us immediately if any detail is incorrect. Our responsibility is to provide the package(s) that we have confirmed to you, subject to the terms and conditions outlined herein. We reserve the right torefuse your booking in which case all money paid to us will be returned in full.
4. Special Requests Any special requests must be made in writing andwhile we will try to honour these, no guarantee can be given. If we are unable to honour any special request no compensation will be payable. If your special request can only be met at additional cost, that cost will be invoiced to you prior to the date of commencement of your package. Unless specifically agreed by us in writing at the time you make your booking, we cannot accept any booking which is made conditional upon a special request being satisfied.
5. Payment Methods Payments can be made using Laser or Credit card over the phone or online through www.comedyshop.ie, by cheque to “Peer Pressure Productions Ltd” or via electronic banking to the following National Irish Bank account. 6. Payment Schedule Reservations made before Tue, May 25th 30% on booking 70% on or before Wed, May 26th
Reservations made on or after Tue, May 25th 100% on booking
7. If you change your booking If you wish to change any details of your booking we’ll do our best to help. Changes to your booking may be subject to a €15 administration fee (per person per change). If any change results in a reduction in the size of your party or the value of your booking then we will recalculate the cost of your booking which may result in group discounts and other incentives being reduced or lost.
If you change your booking within two weeks of the start date of your package then cancellation charges outlined in clause 9 below will apply.
8. If we change your booking We will do our very best to honour your booking as outlined when it is made. However, there may be circumstances which cause us to change the performance, accommodation, restaurant, travel method or other element of a package. We have the right to do this at any time and we will inform you as soon as possible.
If we make a Major change to a package that you have booked, e.g. significant change to performers, significant change in standard of accommodation, change of date you will have the choice of: (a) accepting the changed arrangements (b) accepting a substitute package from us (c) Cancelling the package and having any money paid refunded.
Should you choose (a) or (b) above we will reduce the price of the holiday according to the scale below and if you choose (c) we will refund any money you have paid us and pay compensation according to the following scale:
14 or more days before start of Package: NIL
Between 7 and 13 days before start of Package:
- Option (a) or (b) with Package price of €150 or less per person - €5
- Option (a) or (b) with Package price of over €150 per person - €10
- Option (c) €10
Between 0 and 6 days before start of Package:
- Option (a) or (b) with Package price of €150 or less per person - €10
- Option (a) or (b) with Package price of over €150 per person - €10
- Option (c) €20
NB. A compensation payment discharges all our liabilities to you and by accepting it you agree to waive any other rights you may have. These compensation payments do not apply where a cancellation by us is due to unforeseeable or unusual circumstances beyond our control. Such circumstances or events include (without limitation) war or threat of war, riot, civil strife, industrial dispute, technical problems to transport, closure or congestion of airports, terrorist activity, Acts of God, natural or nuclear disaster, fire and adverse weather conditions or failure by any of our third party suppliers to reasonably anticipate and plan adequately for foreseeable or unusual circumstances.
9. If you cancel A cancellation can only be accepted in writing from the person who completed the booking and is only effective from the date it is received in our offices. If you cancel a package or packages at any time after a booking has been accepted by us then you must pay us a charge to compensate us for the expenses and losses which we will incur as a result of your cancellation.
The following scale of Time before Start of Package cancellation charges as a percentage of total package cost will apply:

10. If we cancel In rare circumstances we may have to cancel a package or packages booked with Comedyshop.ie. Sales of a particular package may not reach a level which would be economical for us to operate and we reserve the right in this or any other circumstance to cancel a package or packages booked with us. In this event we will return to you all money you have paid or offer you an alternative package to purchase of comparable standard if available.
In no circumstances will we cancel the package booked any fewer than three days from the start date of the Package except where this is by reason of unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided, even if all due care had been exercised.
11. Insurance Peer Pressure Productions, Comedyshop.ie, their officers and employees, assume no liability for any loss, theft, damage or injury to property or persons whether arising in contract, negligence, equity or otherwise. Participation in any event organised by us is entirely at your own risk.
12. Our liability We contract accommodation, entertainment and other arrangements through independent suppliers who we have taken reasonable care to ensure are reputable and safe. We do not accept liability for any personal injury or other loss arising whether as a result of the proven negligent acts or omissions of our staff or suppliers.
You expressly understand and agree that in no event shall the Owner of this site, including its agents, affiliates and licensors, be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, and any damages for loss of profits, savings, goodwill or other intangible losses, regardless of whether this site had been advised of or could have foreseen the possibility of such damages, arising out of or in connection with:
(a) the use, inability to use or performance of any of the services of this site,
or
(b) any unauthorized access to or modification to any of your content or transmissions,
or
(c) any other matter relating to this site or any of the services
By booking any of our Day, Overnight or Golden Ticket packages you indicate full acceptance of the Terms and Conditions of our third party suppliers, in particular those of the Carlsberg Cat Laughs Comedy Festival which are available to view at http://www.carlsbergcatlaughs.com/privacy/tc.asp
13. Travel and travel times We reserve the right to change bus or bus supplier at any time. Such change will not be regarded as a Major change for the purpose of this booking.
We will reserve a comfortable, clean and roadworthy vehicle with on-board toilet facilities for any journeys booked through us. We will also ensure that travel times are adequate to allow for reasonably foreseeable traffic or other delays.
However, we will not accept responsibility for failure by any third party travel supplier to honour our arrangements with them.
Some bus journeys may involve stops en route and as factors affecting this are not always known before departure we cannot always notify you in advance, though we will endeavour to do so.
Planned travel times will be outlined in any documentation that you receive. These will be for guidance only. Please check your final itinerary when you receive it as it will show the final schedule.
Please note that the driver or conductor of the bus will have absolute authority over the vehicle and passengers at all times when they are boarding or on board. He can refuse to carry anyone if they are, in his opinion, unfit for any reason to travel or may pose a danger to the vehicle or other passengers.
If you or any person for whom you are booking is refused carriage in these circumstances, the contract with us will terminate immediately and we will have no further responsibility or liability to you.
Arrangements in the event of a travel delay are the responsibility of the third party carrier.
14. Festival Terms and Conditions Please note that the Festival organisers retain the right of admission for all of the events included in the Comedyshop.ie packages. In the event that a performer or performers are unable or unwilling to perform as scheduled the Festival will reschedule or substitute that performer as they see fit. Comedyshop.ie will not accept any responsibility for such alterations to the elements included in our packages which are in the Festival’s control. We will however, engage in dialog with the Festival to ensure that you are kept fully informed of your options and that those options are no less favourable than they would be had you booked your tickets directly with the festival.
In the case of the ‘Golden Ticket’ package which includes access to the Festival Club the rights of admission apply in full and your admission and attendance is at the discretion of the Festival.
Should you be refused admission or ejected from the Festival Club due to breach of any conditions herein or within the Festival’s or venue’s conditions you will not be entitled to any financial or other compensation for that element of your package(s). Equally in the unlikely event that the Festival Club is cancelled no financial compensation will apply.
15. Complaints If you have a complaint about any package booked with us please tell a Comedyshop.ie representative or the supplier of the service concerned immediately, preferably in writing. The problem can then be thoroughly investigated and we can make all efforts to try and remedy the situation there and then to prevent the package experience being spoilt. If your problem still cannot be resolved please contact Peer Pressure office within 28 days of the completion of the package. No liability can be accepted for claims not notified in that period or if the claim was not notified to our representative.
16. Website accuracy We will endeavour to keep the information on our website as up-to-date as possible. However there may be circumstances where an advertised package or element is either modified or not available. Such situations may be dictated by local circumstances, accidental damage to accommodation, adverse weather conditions, or other circumstances beyond our control.
17. Extras All accounts for services and goods, provided as part of any package, which are not covered by the inclusive package cost, must be paid by the client before departing that hotel or commencing an onward or return journey.
18. Your responsibilities It is your responsibility to: a. Ensure a reasonable standard of behaviour by yourself and by those for whom you have booked. We reserve the right to decline to accept or retain any person as a client if their behaviour is, in our opinion, or in the opinion of the bus driver, hotelier, venue manager, accommodation owner or manager or any other person in authority, likely to cause distress, damage, danger or annoyance to other customers, employees, entertainers, other people or to property. You understand that we shall have no liability to pay any refund or compensation or costs incurred by any person whose behaviour is deemed thus to be unacceptable. b. The accommodation arranged for you is only be used by those people named on the booking form. You must not share the accommodation or allow anyone else stay there. c. Advise us in advance of any medical, physical, psychiatric, dietary or other condition which may affect our provision of service to you.
19. Jurisdiction These Terms and Conditions are governed by the laws of the Republic of Ireland and the purchaser and package holder irrevocably submit to the jurisdiction of the Courts of Ireland.
